1. Agreement to Terms

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and Mykola Sereda, a sole proprietorship registered in Poland, Warsaw ("Company," "we," "us," or "our") governing your access to and use of the 7th House mobile dating application and related services (collectively, the "Service").

By downloading, installing, registering with, accessing, or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must not access or use the Service.

2. Eligibility and Age Requirement

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity and authority to enter into these Terms
  • You are not prohibited from using the Service under applicable laws
  • You will comply with all applicable local, state, national, and international laws and regulations
  • All information you provide is accurate, current, and complete

If you are under 18, you are not permitted to use the Service. We reserve the right to verify your age and terminate your account if we discover you are under 18.

3. Account Registration and Security

To use certain features of the Service, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate, current, and complete
  • Maintain the security and confidentiality of your account credentials (username, password, etc.)
  • Accept full responsibility for all activities that occur under your account, whether authorized by you or not
  • Immediately notify us of any unauthorized use of your account or any other breach of security
  • Not share your account credentials with any third party
  • Not create multiple accounts or transfer your account to another person

You are solely responsible for maintaining the confidentiality of your account and password. We are not liable for any loss or damage arising from your failure to protect your account credentials or from unauthorized access to your account.

4. User Conduct and Prohibited Activities

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree NOT to:

  • Use the Service for any illegal, fraudulent, or unauthorized purpose
  • Violate any applicable local, state, national, or international law or regulation
  • Harass, abuse, threaten, harm, intimidate, or discriminate against other users
  • Post, upload, or transmit any content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with any person or entity
  • Post false, misleading, fraudulent, or deceptive information
  • Post or transmit any unsolicited or unauthorized advertising, promotional materials, spam, junk mail, chain letters, or any other form of solicitation
  • Collect or store personal information about other users without their express permission
  • Use automated systems (bots, scripts, scrapers) to access the Service or extract data
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Attempt to gain unauthorized access to the Service, other accounts, computer systems, or networks
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Service
  • Remove, circumvent, or modify any copyright, trademark, or other proprietary notices
  • Use the Service to transmit any viruses, malware, or other harmful code
  • Engage in any activity that could damage, disable, overburden, or impair the Service

Violation of any of these prohibitions may result in immediate termination of your account and may subject you to legal action.

5. User Content and Responsibility

You are solely responsible for all content, information, photos, messages, and other materials ("User Content") that you post, upload, transmit, or share through the Service. You represent and warrant that:

  • You own or have the necessary rights, licenses, and permissions to use and authorize us to use your User Content
  • Your User Content does not violate any third-party rights, including intellectual property, privacy, or publicity rights
  • Your User Content complies with these Terms and all applicable laws
  • Your User Content is accurate and not misleading

You grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your User Content in connection with operating and providing the Service.

We reserve the right, but are not obligated, to review, monitor, edit, or remove any User Content at any time, for any reason, without notice, at our sole discretion. We do not endorse, support, or guarantee the accuracy, completeness, or reliability of any User Content.

6. Astrological Information - Entertainment Only Disclaimer

IMPORTANT NOTICE: ALL ASTROLOGICAL INFORMATION, FORECASTS, PREDICTIONS, COMPATIBILITY SCORES, INSIGHTS, TIPS, AND ANY OTHER ASTROLOGICAL CONTENT PROVIDED BY THE SERVICE IS FOR ENTERTAINMENT AND RECREATIONAL PURPOSES ONLY. ASTROLOGICAL INFORMATION IS NOT BASED ON SCIENTIFIC EVIDENCE AND SHOULD NOT BE RELIED UPON FOR MAKING IMPORTANT LIFE DECISIONS.

The Service provides various astrological features, including but not limited to:

  • Astrological compatibility scores, percentages, and analysis
  • Daily forecasts, tips, insights, and astrological guidance
  • Planetary influences and astrological interpretations
  • Love forecasts, relationship predictions, and advice
  • Element compatibility analysis and interpretations
  • Birth chart calculations, readings, and interpretations
  • Horoscopes, zodiac information, and astrological readings
  • Any other astrological content, features, information, or services

By using the Service, you acknowledge and agree that:

  • ENTERTAINMENT ONLY: All astrological information, forecasts, predictions, compatibility scores, insights, tips, readings, interpretations, and any other astrological content provided by the Service are provided SOLELY AND EXCLUSIVELY FOR ENTERTAINMENT, RECREATIONAL, AND INFORMATIONAL PURPOSES ONLY
  • NOT SCIENTIFIC OR FACTUAL: Astrological information is NOT scientific, is NOT based on empirical evidence or verified facts, is NOT proven, and should NOT be considered as accurate, reliable, truthful, or factual in any way
  • NOT PROFESSIONAL ADVICE: Astrological information is NOT and shall NOT be considered as professional advice of any kind, including but not limited to medical advice, psychological advice, psychiatric advice, legal advice, financial advice, investment advice, relationship counseling, life coaching, or any other form of professional guidance or consultation
  • NOT A SUBSTITUTE: Astrological information is NOT a substitute for professional advice, diagnosis, or treatment from qualified, licensed professionals (including but not limited to doctors, psychologists, psychiatrists, lawyers, financial advisors, therapists, counselors, or other licensed professionals)

  • NO WARRANTIES: We make absolutely NO WARRANTIES, representations, promises, or guarantees of any kind, express or implied, about the accuracy, completeness, reliability, usefulness, truthfulness, validity, effectiveness, or quality of any astrological information
  • MAY BE INACCURATE: Astrological information may be (and likely is) inaccurate, incomplete, incorrect, misleading, false, or entirely fictional
  • YOUR SOLE RESPONSIBILITY: You assume and accept full, complete, and sole responsibility and risk for any and all decisions, actions, choices, or consequences that result from your use of, reliance on, or consideration of astrological information
  • NO LIABILITY: We are NOT responsible, NOT liable, and shall NOT be held accountable in any way for any consequences, outcomes, losses, damages, harm, injuries, or negative results of any kind whatsoever resulting from your use of, reliance on, belief in, or consideration of astrological information
  • USER INTERPRETATION: How you choose to perceive, interpret, believe, or use astrological information is entirely your own choice and responsibility. We disclaim responsibility for how you interpret or act upon astrological content
  • SEEK PROFESSIONAL HELP: For any serious life decisions, problems, or issues, you must seek qualified professional advice from licensed professionals in the relevant field

By using the Service, you acknowledge and agree that you understand that astrological information is for entertainment purposes only and should not be relied upon for important decisions. You agree not to hold us liable for any outcomes, decisions, or consequences related to your use of or reliance on astrological information. Your continued use of the Service constitutes your acceptance of this disclaimer.

7. User Interactions and Dating Services

The Service facilitates connections and interactions between users. You acknowledge and agree that:

  • We are NOT responsible for the conduct, behavior, or actions of any user, whether online or offline
  • We do NOT conduct background checks or verify the identity, age, or information of users
  • We do NOT guarantee the accuracy, completeness, or truthfulness of information provided by other users
  • You are solely responsible for your interactions with other users
  • You should exercise caution and use your best judgment when interacting with other users
  • You should not share personal information (such as home address, financial information, etc.) with other users until you are comfortable doing so
  • You should meet in public places for initial in-person meetings and inform friends or family of your plans
  • We are NOT responsible for any harm, loss, damage, or negative consequences resulting from your interactions with other users

You understand that we cannot and do not guarantee the safety, security, or appropriateness of any user or user interaction. You use the Service and interact with other users at your own risk.

8. Scams, Fraud, Deception, and Complete User Responsibility

IMPORTANT SAFETY WARNING: You are responsible for protecting yourself from scams, fraud, deception, manipulation, identity theft, catfishing, romance scams, and other harmful or deceptive practices by other users or third parties. We do not assume responsibility for your safety, security, or protection when interacting with other users.

By using the Service, you acknowledge and agree that:

  • NO RESPONSIBILITY FOR USER CONDUCT: We are NOT responsible, NOT liable, and bear NO responsibility whatsoever for any scams, fraud, deception, lies, manipulation, theft, robbery, assault, harassment, stalking, identity theft, catfishing, romance scams, financial scams, illegal activities, criminal activities, or any other harmful, dangerous, or illegal conduct by any users, third parties, or anyone you interact with through the Service
  • NO VERIFICATION OR MONITORING: We do NOT conduct background checks, identity verification, criminal background checks, reference checks, or any other verification of users. We do NOT monitor, screen, vet, verify, validate, authenticate, or guarantee the authenticity, legitimacy, honesty, truthfulness, identity, age, criminal history, marital status, financial status, intentions, character, or any other aspect of any user or user content
  • USERS MAY BE DANGEROUS: You acknowledge and accept that other users may be dishonest, deceitful, fraudulent, dangerous, violent, criminals, sex offenders, married, underage (despite age restrictions), scammers, identity thieves, catfishers, or otherwise harmful or dangerous
  • YOUR SOLE RESPONSIBILITY TO VERIFY: You are solely, completely, and exclusively responsible for verifying the identity, age, background, criminal history, intentions, honesty, legitimacy, and truthfulness of all users you interact with. You must conduct your own due diligence, background checks, and verification
  • WARNING SIGNS: You acknowledge that you should be extremely cautious of users who: ask for money or financial assistance; request gift cards, wire transfers, or cryptocurrency; request personal financial information; refuse to meet in person; avoid video calls or phone calls; provide inconsistent, vague, or suspicious information; claim to be overseas or traveling; profess love or strong feelings quickly; have emergencies or urgent financial needs; or exhibit any other suspicious behavior
  • REPORTING DOES NOT CREATE OBLIGATION: While you may report suspicious, fraudulent, or harmful behavior to us, we are NOT obligated to investigate, take action, respond, remove users, ban users, refund payments, compensate you, or do anything in response to your report. Reporting does NOT create any duty, obligation, or responsibility on our part
  • NO LIABILITY FOR SCAMS: If you are scammed, defrauded, deceived, manipulated, robbed, assaulted, harassed, stalked, catfished, lied to, stolen from, or harmed in any way by another user or third party, WE ARE NOT LIABLE, NOT RESPONSIBLE, and bear ABSOLUTELY NO RESPONSIBILITY OR LIABILITY for any losses, damages, harm, injuries, financial losses, emotional distress, psychological harm, physical harm, or any other consequences whatsoever
  • ASSUMPTION OF ALL RISKS: You expressly assume, accept, and bear ALL risks associated with using a dating service, meeting strangers, interacting with other users, sharing personal information, sending money, meeting in person, or any other activities related to the Service
  • NO RESPONSIBILITY FOR FINANCIAL LOSSES: We are NOT responsible or liable for any financial losses, stolen money, unauthorized charges, identity theft, credit card fraud, bank account theft, or any other financial harm or losses resulting from your use of the Service or interactions with other users
  • NO RESPONSIBILITY FOR EMOTIONAL HARM: We are NOT responsible or liable for any emotional harm, distress, trauma, heartbreak, depression, anxiety, psychological damage, or mental health consequences resulting from your use of the Service or interactions with other users
  • NO RESPONSIBILITY FOR PHYSICAL HARM: We are NOT responsible or liable for any physical harm, injuries, assault, violence, sexual assault, kidnapping, murder, or any other physical dangers or consequences resulting from your use of the Service or interactions with other users
  • YOUR ACTIONS ARE YOUR RESPONSIBILITY: If you choose to send money, share financial information, meet in person, share personal information, engage in intimate activities, travel to meet someone, or take any other actions based on interactions through the Service, those decisions and actions are entirely your own responsibility and choice. We bear NO responsibility for your decisions or their consequences
  • THIRD-PARTY INVOLVEMENT: We are NOT responsible for scams, fraud, or harm involving third parties that users may direct you to, including websites, payment services, investment schemes, or any other third-party services or individuals
  • USER RESPONSIBILITY FOR DUE DILIGENCE: You expressly acknowledge and agree that you are responsible for exercising reasonable caution, care, and due diligence when using the Service and interacting with other users. Any negative consequences resulting from your failure to exercise such caution are your own responsibility

By using the Service, you acknowledge that you understand and accept the risks associated with online dating, meeting strangers, and interacting with unverified users. You agree that you will not hold us responsible or liable for scams, fraud, deception, harm, losses, damages, or other negative outcomes. You are responsible for your own safety, security, and protection.

9. Premium Features and Subscriptions

Certain features of the Service require a paid subscription ("Premium Features"). By purchasing a subscription, you agree to:

  • Pay all fees associated with your subscription at the prices displayed at the time of purchase
  • Provide accurate and complete payment information
  • Authorize us or our payment processors to charge your payment method for all subscription fees
  • Understand that subscription fees are charged in advance on a recurring basis (monthly, quarterly, or annually, as selected)
  • Understand that subscriptions automatically renew unless cancelled before the renewal date
  • Cancel your subscription through your device's app store settings or by contacting us
  • Understand that cancellation will take effect at the end of the current billing period
  • Understand that we do not provide refunds for unused portions of subscriptions, except as required by law

We reserve the right to change subscription prices at any time. Price changes will not affect your current subscription period but will apply to subsequent renewal periods.

All fees are non-refundable unless otherwise required by applicable law. If you dispute any charges, you must notify us within 60 days of the charge date.

10. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by the Company and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use in accordance with these Terms.

You may not copy, modify, distribute, sell, lease, sublicense, reverse engineer, or create derivative works of the Service or any part thereof without our express written permission. All rights not expressly granted are reserved.

11. Termination

We reserve the right, at our sole discretion, to suspend or terminate your account and access to the Service at any time, for any reason or no reason, with or without notice, including but not limited to:

  • Violation of these Terms or our Privacy Policy
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Requests by law enforcement or government agencies
  • Discontinuation or material modification of the Service
  • Technical or security issues

You may terminate your account at any time by deleting the app or contacting us at support@7thhouse.app.

Upon termination, your right to use the Service will immediately cease. We may delete your account and User Content, and we are not obligated to retain or provide you with any of your User Content. Sections of these Terms that by their nature should survive termination will survive, including but not limited to disclaimers, limitations of liability, and indemnification.

12. Disclaimers of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

We expressly disclaim all warranties, express or implied, including but not limited to:

  • Warranties of merchantability, fitness for a particular purpose, and non-infringement
  • Warranties that the Service will be uninterrupted, timely, secure, error-free, or free from viruses or other harmful components
  • Warranties regarding the accuracy, reliability, completeness, or usefulness of any information, content, or services provided
  • Warranties that defects will be corrected
  • Warranties regarding user interactions, matches, or connections
  • Warranties regarding the safety, security, or appropriateness of users or user content

We do not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered by a third party through the Service, and we will not be a party to or in any way monitor any transaction between you and third-party providers.

13. Limitation of Liability and Complete Disclaimer of Responsibility

TO THE ABSOLUTE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE COMPANY (MYKOLA SEREDA), ITS OWNER, SOLE PROPRIETOR, EMPLOYEES, CONTRACTORS, AGENTS, REPRESENTATIVES, PARTNERS, AFFILIATES, SUCCESSORS, ASSIGNS, SERVICE PROVIDERS, OR ANY OTHER RELATED PARTIES BE LIABLE, RESPONSIBLE, OR HELD ACCOUNTABLE FOR ANY DAMAGES, LOSSES, HARM, INJURIES, COSTS, EXPENSES, OR CONSEQUENCES OF ANY KIND WHATSOEVER, INCLUDING BUT NOT LIMITED TO ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, EXEMPLARY, STATUTORY, OR ANY OTHER TYPE OF DAMAGES, WHETHER FORESEEABLE OR UNFORESEEABLE, INCLUDING BUT NOT LIMITED TO:

  • FINANCIAL DAMAGES: Loss of profits, revenue, income, business, savings, data, use, goodwill, money, financial losses of any kind, investment losses, theft, fraud, scams, unauthorized charges, identity theft, credit card fraud, wire transfer fraud, cryptocurrency losses, or any other financial or economic losses or damages
  • SERVICE-RELATED DAMAGES: Damages resulting from your use of, inability to use, interruption of, suspension of, termination of, errors in, bugs in, downtime of, unavailability of, malfunction of, or any other issues with the Service
  • USER INTERACTION DAMAGES: Damages, harm, losses, or injuries resulting from interactions with other users, including but not limited to scams, fraud, deception, lies, catfishing, romance scams, harassment, stalking, abuse, threats, intimidation, assault, violence, sexual assault, rape, kidnapping, murder, robbery, theft, manipulation, emotional abuse, or any other harmful conduct by users
  • ASTROLOGICAL CONTENT DAMAGES: Damages, consequences, or losses resulting from reliance on, belief in, use of, or consideration of astrological information, forecasts, predictions, compatibility scores, daily tips, planetary influences, love forecasts, element compatibility, horoscopes, or any other astrological content provided by the Service
  • DECISION-MAKING DAMAGES: Damages or consequences resulting from decisions you make based on the Service, including relationship decisions, dating decisions, marriage decisions, breakup decisions, financial decisions, career decisions, or any other life decisions
  • PHYSICAL HARM DAMAGES: Physical harm, injuries, illness, disability, disfigurement, death, assault, violence, or any other physical consequences resulting from your use of the Service or interactions with other users
  • EMOTIONAL AND PSYCHOLOGICAL DAMAGES: Emotional harm, distress, trauma, heartbreak, mental anguish, depression, anxiety, psychological damage, mental health consequences, loss of consortium, or any other emotional or psychological harm or suffering
  • DATA AND PRIVACY DAMAGES: Damages resulting from unauthorized access to, loss of, theft of, disclosure of, alteration of, destruction of, breach of, hacking of, or any other compromise of your data, personal information, account, transmissions, photos, messages, or privacy
  • THIRD-PARTY DAMAGES: Damages resulting from the conduct, content, actions, or omissions of third parties, other users, service providers, advertisers, payment processors, or any other third parties
  • CONTENT DAMAGES: Damages resulting from any content provided through the Service, including user-generated content, astrological content, advice, information, recommendations, or any other content
  • SECURITY DAMAGES: Damages resulting from security breaches, cyberattacks, hacking, malware, viruses, unauthorized access, data breaches, or any other security issues
  • ACCOUNT DAMAGES: Damages resulting from account suspension, termination, deletion, closure, loss of access, inability to access, or any other account-related issues
  • PAYMENT DAMAGES: Damages resulting from payment processing, billing errors, unauthorized charges, refund denials, subscription renewals, or any other payment-related issues
  • TECHNICAL DAMAGES: Damages resulting from technical issues, bugs, errors, glitches, crashes, data loss, compatibility issues, or any other technical problems
  • MATCHING DAMAGES: Damages resulting from matching algorithms, compatibility calculations, suggested matches, failed matches, incompatible matches, or any other matching-related issues
  • COMMUNICATION DAMAGES: Damages resulting from messages, communications, notifications, emails, or any other communications sent through or by the Service
  • REPUTATION DAMAGES: Damages to reputation, character, standing, or public image resulting from use of the Service
  • LEGAL DAMAGES: Legal fees, attorney fees, court costs, settlement costs, or any other legal expenses resulting from your use of the Service
  • ANY OTHER DAMAGES: Any and all other damages, losses, harm, injuries, costs, expenses, liabilities, or consequences of any nature, kind, or type whatsoever, whether known or unknown, foreseen or unforeseen, disclosed or undisclosed, that result from, arise out of, relate to, or are connected in any way to the Service, your use of the Service, your inability to use the Service, or any matter relating to the Service

THIS COMPLETE AND ABSOLUTE LIMITATION OF LIABILITY APPLIES REGARDLESS OF:

  • The legal theory, basis, or cause of action on which any claim is based (including but not limited to contract, tort, negligence, gross negligence, strict liability, breach of warranty, misrepresentation, fraud, product liability, or any other legal theory)
  • Whether we were advised, knew, or should have known of the possibility of such damages
  • Whether the damages were foreseeable or unforeseeable
  • The failure of any remedy to achieve its essential purpose
  • Whether the damages resulted from our negligence, gross negligence, or other fault

MAXIMUM LIABILITY CAP: In jurisdictions that do not allow the complete exclusion or limitation of liability for consequential, incidental, or other damages, our total aggregate liability to you for all claims, damages, losses, and causes of action, whether in contract, tort, negligence, or otherwise, shall be limited to the maximum extent permitted by applicable law. In no event shall our total aggregate liability to you for all damages, losses, and causes of action exceed the LESSER of: (a) the total amount you actually paid to us (if any) in the twelve (12) months immediately preceding the event giving rise to the claim, or (b) $100 USD (one hundred United States dollars).

IMPORTANT: Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our gross negligence or willful misconduct; (b) fraud or fraudulent misrepresentation; (c) any liability that cannot be excluded or limited under applicable law. These limitations apply to the fullest extent permitted by the laws of your jurisdiction.

ASSUMPTION OF ALL RISKS: You expressly, irrevocably, and unconditionally acknowledge, understand, and agree that you assume full, complete, sole, and exclusive responsibility and risk for:

  • Your use of the Service and all activities conducted through your account
  • All interactions, communications, and meetings with other users, whether online or offline
  • All risks associated with online dating, meeting strangers, and sharing personal information
  • All risks associated with scams, fraud, deception, catfishing, and other harmful practices
  • All decisions you make based on the Service, astrological information, or interactions with other users
  • All content you post, upload, share, or transmit through the Service
  • All financial transactions, payments, or money you send to other users or third parties
  • Your physical safety and security
  • Your emotional and psychological well-being
  • Your privacy and data security
  • Any and all other aspects, risks, consequences, or outcomes related to the Service

BY USING THE SERVICE, YOU ACKNOWLEDGE AND AGREE THAT YOU ASSUME RESPONSIBILITY FOR ALL RISKS ASSOCIATED WITH USING THE SERVICE, AND THAT TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR DAMAGES, LOSSES, HARM, OR CONSEQUENCES ARISING FROM YOUR USE OF THE SERVICE. YOU UNDERSTAND THAT YOUR USE OF THE SERVICE IS VOLUNTARY AND AT YOUR OWN DISCRETION. THIS LIMITATION OF LIABILITY IS A FUNDAMENTAL PART OF THE BASIS OF THE BARGAIN BETWEEN YOU AND US.

14. Indemnification and Hold Harmless

  • Any harm, loss, damage, injury, death, or consequences of any kind caused by you or allegedly caused by you to other users, third parties, or anyone else
  • Your reliance on, belief in, use of, or consideration of astrological information, forecasts, predictions, compatibility scores, or any other content provided by the Service
  • Any decisions, actions, or choices you make based on the Service, astrological information, user interactions, or any other aspect of the Service
  • Any fraudulent, deceptive, illegal, harmful, or improper conduct or activities by you
  • Your negligence, gross negligence, recklessness, intentional misconduct, or willful acts or omissions
  • Any breach of security, unauthorized access, or compromise of your account resulting from your failure to protect your account credentials
  • Any claims, disputes, or issues between you and other users or third parties
  • Any allegation that your User Content or your use of the Service infringes, misappropriates, or violates any third-party rights
  • Any taxes, fees, or charges owed by you in connection with your use of the Service
  • Any misrepresentation or false statement made by you
  • Any activity conducted under or through your account, whether authorized by you or not, if resulting from your failure to secure your account
  • Any and all other matters arising from, relating to, or connected with your use of the Service or these Terms

This indemnification obligation means that you will be financially responsible for and will pay all costs, expenses, damages, settlements, judgments, and attorney fees that the Indemnified Parties incur as a result of any claims or legal actions arising from the matters listed above.

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate fully with us in asserting any available defenses. You may not settle any claim subject to this indemnification without our prior written consent.

This indemnification obligation is a material term of these Terms and will survive and continue in full force and effect after termination of these Terms, closure of your account, discontinuation of the Service, or cessation of your use of the Service for any reason.

15. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved through good faith negotiations. If a dispute cannot be resolved through negotiations, you agree to submit to the exclusive jurisdiction of the courts of Warsaw, Poland. You hereby irrevocably waive any objection to such jurisdiction and venue on the grounds of forum non conveniens or otherwise.

You waive any right to a jury trial and agree that any dispute will be resolved on an individual basis and not as part of a class action.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

17. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and the Company regarding the Service and supersede all prior and contemporaneous agreements, proposals, or representations, whether written or oral.

18. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect by posting the updated Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any such modifications constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service and delete your account.

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
